Webinar No. 2: Preparing for the BIOSECURE Act

We are delighted to invite you to the third session of our “Spotlight on the U.S.” sessions within our APAC life sciences and health care webinar series on Tuesday, 14 May 2024.

Proposals have been making their way through both houses of Congress that would restrict U.S. life sciences companies that contract with the U.S. government doing business with certain identified Chinese development and manufacturing organizations, including WuXi AppTec, among others. As bases for these proposals, lawmakers have cited national security concerns as well as a need to curtail U.S. reliance on biotechnology companies in the PRC and to safeguard U.S. persons’ genetic and other data. The current House proposal, known as "the BIOSECURE Act," is broad enough to restrict government contractors from doing commercial business with any of the identified companies involving “biotechnology equipment or services.” Both House and Senate proposals reportedly have broad support in Congress and in the Biden Administration.

Certain members of Congress also have called on the Biden Administration to place the Chinese companies of concern on U.S. restricted parties lists, which could prohibit certain transactions with these entities, including exports of technology and materials.

It is expected that if either proposal is enacted into law in current form and/or if the Biden Administration designates these entities on restricted party lists, the impact on the biotechnology industry as a whole will be far-reaching.
